Prison Disciplinary Hearings

A rapidly expanding area of law which is currently being reviewed by the European Court of Human Rights for its compliance with Article 6 of the European Convention.

This group is represented by a dedicated team of barristers who conduct work in this area throughout the country.

While prison disciplinary hearings are not to be treated as equivalent to courts of law in terms of the rules of evidence and procedure, a crucial obligation is to ensure that prisoners are given a fair hearing. Accordingly, at an inquiry into a charge against a prisoner, he must be given a full opportunity of hearing what is alleged against him and an opportunity to seek representation.

A governor's conduct of a disciplinary hearing is also susceptible to judicial review where there has been such unfairness as to cause substantial injustice.
