Insolvency Law

Insolvency legislation and rules comprise a separate jurisdiction in the County Court and Chancery Division of the High Court. Members of the team are able to produce advice on merits and procedure in the following areas:

Limited companies
  • Winding up petitions of companies by creditors;
  • Winding up petitions brought on 'just and equitable' grounds by contributories;
  • Rescission of winding up orders;
  • Wrongful & Fraudulent Trading;
  • Director's disqualification proceedings;
  • Applications under the Insolvency Act;
  • Applications by Insolvency Practitioners.
Individuals
  • Bankruptcy petitions;
  • Setting aside of bankruptcy orders;
  • Applications for leave to continue proceedings against a bankrupt;
  • Offences under insolvency legislation.

Members of the team are able to provide representation at court on any of these areas.
